These Terms and Conditions (together with the documents referred to in it which are hereby incorporated by reference) (collectively, “App T&Cs”) informs you of the terms on which you may use our application (“App”), whether as a guest or a registered user. Use of the App includes accessing, browsing, or registering to use the App and the functions and services offered on or made available through the App (collectively “App Functions”).
Upon downloading or utilizing the Application, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Application. Unauthorized copying, modification of the Application, any part of the Application, or our trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.
The Service Provider is dedicated to ensuring that the Application is as beneficial and efficient as possible. As such, they reserve the right to modify the Application or charge for their services at any time and for any reason. The Service Provider assures you that any charges for the Application or its services will be clearly communicated to you.
The Application stores and processes personal data that you have provided to the Service Provider in order to provide the Service. It is your responsibility to maintain the security of your phone and access to the Application. The Service Provider strongly advise against jailbreaking or rooting your phone, which involves removing software restrictions and limitations imposed by the official operating system of your device. Such actions could expose your phone to malware, viruses, malicious programs, compromise your phone's security features, and may result in the Application not functioning correctly or at all.
Please be aware that the Service Provider does not assume responsibility for certain aspects. Some functions of the Application require an active internet connection, which can be Wi-Fi or provided by your mobile network provider. The Service Provider cannot be held responsible if the Application does not function at full capacity due to lack of access to Wi-Fi or if you have exhausted your data allowance.
If you are using the application outside of a Wi-Fi area, please be aware that your mobile network provider's agreement terms still apply. Consequently, you may incur charges from your mobile provider for data usage during the connection to the application, or other third-party charges. By using the application, you accept responsibility for any such charges, including roaming data charges if you use the application outside of your home territory (i.e., region or country) without disabling data roaming. If you are not the bill payer for the device on which you are using the application, they assume that you have obtained permission from the bill payer.
Similarly, the Service Provider cannot always assume responsibility for your usage of the application. For instance, it is your responsibility to ensure that your device remains charged. If your device runs out of battery and you are unable to access the Service, the Service Provider cannot be held responsible.
In terms of the Service Provider's responsibility for your use of the application, it is important to note that while they strive to ensure that it is updated and accurate at all times, they do rely on third parties to provide information to them so that they can make it available to you. The Service Provider accepts no liability for any loss, direct or indirect, that you experience as a result of relying entirely on this functionality of the application.

2.2 With your XVerified purchase, we grant you a limited, non-exclusive, non- transferable license to access XVerified content and view your selected course(s) through the service on a streaming-only basis for personal purposes.
2.3 Except for the limited license granted in Clause 2.2, no rights, title, or interest in the content or services shall be transferred to you. You agree not to use the XVerified service for public performances or any unauthorized purposes.
2.4 XVerified reserves the right to revoke your license at any time at its sole discretion. Upon revocation, you must promptly destroy any content downloaded or otherwise obtained through the service, including any copies made, regardless of whether they were made in accordance with these Terms of Service or otherwise.
3. Intellectual Property Rights
3.1 You acknowledge that the Service contains content, features, and technology (“Service Content”) protected by intellectual property laws, including copyright, patents, trademarks, trade secrets, and other proprietary rights. Except as expressly authorized by XVerified, you may not modify, copy, frame, scrape, lease, sell, distribute, or create derivative works based on the Service or Service Content, except for your own User Content (defined below) that you legally upload.
3.2 You agree not to use data mining, robots, scraping, or similar data extraction methods. If XVerified blocks your access (e.g., by IP address), you may not attempt to circumvent such measures (e.g., by masking or proxying your IP address). Unauthorized use of the Service or Service Content is strictly prohibited.
3.3 The underlying technology and software of the Service are the exclusive property of XVerified , its affiliates, or partners (collectively, the “Software”). You agree not to reverse-engineer, modify, create derivative works of, sublicense, or otherwise transfer any rights in the Software. All rights not expressly granted herein are reserved by XVerified.
3.4 The XVerified name, logos, and trademarks (“XVerified Trademarks”) are the exclusive property of XVerified. Other product and service names displayed on the Service may be trademarks of their respective owners. No rights to use any trademarks are granted without prior written consent. All goodwill arising from the use of XVerified Trademarks inures exclusively to XVerified.
3.5 XVerified is not responsible for third-party content or materials accessed via the Service, including errors, omissions, or damages resulting from their use. Although XVerified does not pre-screen content, it reserves the right to remove content that violates these Terms or is deemed objectionable at its sole discretion. You agree to evaluate and assume all risks associated with third-party content, including its accuracy and completeness.
3.6 By uploading content to the Service (“User Content”), you represent that you own all rights, including copyrights and publicity rights, and that your content does not violate any third-party rights. You grant XVerified and its affiliates a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, adapt, distribute, and otherwise exploit your User Content across all media and technologies.
3.7 Any feedback, suggestions, or ideas provided to XVerified (“Submissions”) are non- confidential, and XVerified may use them without acknowledgment or compensation.
3.8 XVerified reserves the right to preserve and disclose content as required by law or when necessary to:

4. Use of App Content
4.1 You may not reproduce, modify, adapt, translate, publish, display, communicate, transmit, broadcast, frame, scrape, podcast, webcast, distribute, sell, trade or exploit for any commercial or other purposes, any portion of, or any access to (unless otherwise expressly permitted in accordance with written law or with our prior written consent):
4.2 Without prejudice to the generality of the foregoing, you agree not to reproduce, display or otherwise provide access to the App and/or the App Functions, Content or Third-Party Content on another application or server, for example through linking, framing, mirroring or any other technological means whether available now or in the future unless the prior written consent of XVerified is obtained.
4.3 You may, provided you have kept all copyright and other proprietary notices intact, download or print one copy of the information available on the App for your personal, internal and non-commercial use only. Permission to reprint or electronically reproduce any part of the App, App Functions, Content or Third-Party Content whether in whole or in part for any other purpose is expressly prohibited without XVerified’ prior written consent, and the written consent of the owners of Third-Party Content.
4.4 You may not decompile, reverse engineer or otherwise attempt to discover the source code of any XVerified Content available on the App or provided through a App Function except under the specific circumstances expressly permitted by law or XVerified in writing.
4.5 Without prejudice to the rights and remedies which are available to us at law, we reserve the right to terminate the privileges of any member or user who repeatedly breaches paragraphs 4.3 and 4.4.
5. Online Conduct
5.1 The Service and its features are made available for your personal, non-commercial use only. Businesses, organizations, or other legal entities may not use the Service or its features for any purpose.
5.2 You represent, warrant, and undertake to us as follows: 5.2.1 Any information that you submit to the Service or via its features shall not: a. be illegal, obscene, threatening, defamatory, invasive of privacy, infringe on intellectual property rights, or otherwise injurious to third parties or objectionable; b. consist of or contain software viruses, commercial solicitation, chain letters, mass mailings, or any form of "spam"; c. contain information or statements contrary to public interest, public morality, public order, or public security, or otherwise be prohibited by applicable laws or regulations;
5.3 You understand and agree that we may review, edit, or delete (but are not obligated to do so) any information, messages, photos, or profiles that, in our sole judgment, violate these Terms of Service or which may be offensive, illegal, or violate the rights, harm, or threaten the safety of any Service users.

6.1 If you choose, or you are provided with, a username, code, password or any other piece of information as part of our security procedures, you must treat such information as confidential and you must not disclose it to any third party. You also agree that you will be the only authorized user of the App and/or the App Functions using your username and password. You agree not to provide or make known your username and password to any other person for any purpose, including to facilitate that person's access and unauthorized use of the App and/or the App Functions.
6.2 We have the right to disable any user identification code or password whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of these App T&Cs.

7.1 You may enable or log in to the Service via various online third-party services, such as social media and social networking services like Facebook or Twitter (“Social Networking Services”). By logging in or directly integrating these Social Networking Services into the Service, we make your online experiences richer and more personalized. To take advantage of this feature and its capabilities, we may ask you to authenticate, register for, or log into Social Networking Services on the App of their respective providers.
7.2 As part of such integration, the Social Networking Services will provide us with access to certain information that you have provided to such Social Networking Services, and we will use, store, and disclose such information in accordance with our Privacy Policy. For more information about the implications of activating these Social Networking Services and XVerified’s use, storage, and disclosure of information related to you and your use of such services within XVerified (including your friend lists and the like), please see our Privacy Policy.
7.3 However, please remember that the manner in which Social Networking Services use, store, and disclose your information is governed solely by the policies of such third parties, and XVerified shall have no liability or responsibility for the privacy practices or other actions of any third-party site or service that may be enabled within the Service.
7.4 In addition, XVerified is not responsible for the accuracy, availability, or reliability of any information, content, goods, data, opinions, advice, or statements made available in connection with Social Networking Services. As such, XVerified is not liable for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Social Networking Services. XVerified enables these features merely as a convenience, and the integration or inclusion of such features does not imply an endorsement or recommendation.
8. Disclaimer of Warranties and Liability
DISCLAIMER: THIS SITE AND THE INFORMATION IT CONTAINS IS MADE AVAILABLE ON AN "AS IS AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED.
8.1 To the maximum extent permitted by law, you irrevocably agree and acknowledge that:
8.2 XVerified is a third-party authentication service and is not developed, affiliated, or endorsed by the respective brands whose products are authenticated through this platform. As such, XVerified assumes no liability for claims, damages, or losses arising from the use of the Service in connection with these brands.
8.3 Further, nothing in these App Terms and Conditions constitutes any representation or warranty by XVerified regarding your rights (if any) to use any content submitted by third parties, including Third Party Content. All such representations and warranties are expressly disclaimed.
9. Cancellation or Modification of Orders
9.1 XVerified reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
9.2 You agree that XVerified will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.
9.3 XVerified has no obligation to retain any of your account information or submitted content for any period beyond what is required by applicable law.
10. Termination
10.1. We reserve the right to terminate or suspend your use of the App without prior notice to you, at any time and for any or no reason including inappropriate behaviour on the App. Without limiting the foregoing, if you breach these App T&Cs or conduct yourself in a manner that we deem to be detrimental to the integrity, security and operation of the App, the App Functions or any information systems connected or in operation with the same, we reserve the right to suspend or permanently terminate your access to the App and the App Functions for any reason in our sole and absolute discretion.
10.2. You agree and acknowledge that any suspension or termination of your access to the App may be affected without prior notice, and agree that the App may immediately deactivate. Further, you agree and acknowledge that to the maximum extent permitted under applicable law, we shall not be liable for the discontinuation or termination of your access to the App.
